Terms and Conditions

This agreement applies as between you, the User of this Website and Manufacturing Excellence Institute, the owner(s) of this Website. Your agreement to comply with and be bound by Clauses 1, 2, 4 – 11 and 15 – 25 of these Terms and Conditions is deemed to occur upon your first use of the Website. Clauses 3 and 12 – 14 apply only to the sale of Services. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and Our acceptance of that offer is deemed to occur upon Our sending a confirmation email to you indicating that your order has been accepted.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:
"Account": means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on the Website;
"Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
"Facilities": means collectively any online facilities, tools, services or information that Manufacturing Excellence Institute makes available through the Website either now or in the future;
"Services": means the services available to you through this Website, specifically use of the Manufacturing Excellence Institute proprietary e-learning platform;
"Payment Information": means any details required for the purchase of Services from this Website. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;
"Premises": Means Our place(s) of business;
"System": means any online communications infrastructure that Manufacturing Excellence Institute makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
"User" / "Users": means any third party that accesses the Website and is not employed by Manufacturing Excellence Institute and acting in the course of their employment;
"Website": means the website that you are currently using (institute.manufacturingx.com) and any sub-domains of this site (e.g. subdomain.yourschool.com) unless expressly excluded by their own terms and conditions; and
"We/Us/Our": means Manufacturing Excellence Institute, a commercial name (trade name/business name/DBA) property of Edgar Sosa Rivas and registered trademark at the IMPI (Mexican Institute of Industrial Property) with registration number 1892653 located in Tlajomulco, Jalisco 45646, United Mexican States.

2. Age Restrictions

Persons under the age of 18 should use this Website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

3. Business Customers

These Terms and Conditions also apply to customers procuring Services in the course of business.

4. Intellectual Property

  • 4.1 Subject to the exceptions in Clause 5 of these Terms and Conditions, all Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Manufacturing Excellence Institute, our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable Mexican and International intellectual property and other laws.
  • 4.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given Our express written permission to do so.

  • 5.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.
  • 5.2 Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on the Website or unless given express written permission to do so by the relevant manufacturer or supplier.

  • 9.1 When using any System on the Website you should do so in accordance with the following rules. Failure to comply with these rules may result in your Account being suspended or closed:
  • 9.1.1 You must not use obscene or vulgar language;
  • 9.1.2 You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
  • 9.1.3 You must not submit Content that is intended to promote or incite violence;

  • 9.2 You acknowledge that Manufacturing Excellence Institute reserves the right to monitor any and all communications made to Us or using Our System.
  • 9.3 You acknowledge that Manufacturing Excellence Institute may retain copies of any and all communications made to Us or using Our System.
  • 9.4 You acknowledge that any information you send to Us through Our System may be modified by Us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon Our use of such information must be communicated to Us in advance and We reserve the right to reject such terms and associated information.

10. Accounts

  • 10.1 In order to procure Services on this Website and to use certain other parts of the System, you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as We may not require payment information until you wish to make a purchase. By continuing to use this Website you represent and warrant that:
  • 10.1.1 all information you submit is accurate and truthful;
  • 10.1.2 you have permission to submit Payment Information where permission may be required; and
  • 10.1.3 you will keep this information accurate and up-to-date. Your creation of an Account is further affirmation of your representation and warranty.
  • 10.2 It is recommended that you do not share your Account details, particularly your username and password. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
  • 10.3 If you have reason to believe that your Account details have been obtained by another person without consent, you should contact Us immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending. Please be aware that orders or payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying Us of the unauthorised nature of the order or payment then you shall be charged for the period from the commencement of the provision of services until the date you notified us and may be charged for a billing cycle of one month.
  • 10.4 When choosing your username you are required to adhere to the terms set out above in Clause 9. Any failure to do so could result in the suspension and/or deletion of your Account.

11. Termination and Cancellation of Accounts

  • 11.1 Either Manufacturing Excellence Institute or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.
  • 11.2 If We terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

12. Services, Pricing and Availability

  • 12.1 Whilst every effort has been made to ensure that all general descriptions of Services available from Manufacturing Excellence Institute correspond to the actual Services that will be provided to you, We are not responsible for any variations from these descriptions as the exact nature of the Services may vary depending on your individual requirements and circumstances. This does not exclude Our liability for mistakes due to negligence on Our part and refers only to variations of the correct Services, not different Services altogether. Please refer to sub-Clause 13.8 for incorrect Services.
  • 12.2 Where appropriate, you may be required to select the required Plan of Services.
  • 12.3 We neither represent nor warrant that such Services will be available at all times and cannot necessarily confirm availability until confirming your Order. Availability indications are not provided on the Website.
  • 12.4 All pricing information on the Website is correct at the time of going online and is expressed in US Dollars (USD) unless otherwise stated, however you may be charged in equivalent local currency where applicable. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary.
  • 12.5 In the event that prices are changed during the period between an order being placed for Services and Us processing that order and taking payment, then the price that was valid at the time of the order shall be used.

13. Orders and Provision of Services

  • 13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may, at Our sole discretion, accept. Our acceptance is indicated by Us sending to you an order confirmation email. Only once We have sent you an order confirmation email will there be a binding contract between Manufacturing Excellence Institute and you.
  • 13.2 Order confirmations under sub-Clause 13.1 will be sent to you before the Services begin and shall contain the following information:
  • 13.2.1 Confirmation of the Services ordered including details of the main characteristics of those Services.
  • 13.2.2 Itemized pricing for the Services ordered. Customers in Mexico that need a legal invoice shall request it to sales@manufacturingx.com
  • 13.2.3 Relevant times and dates for the provision of the Services;
  • 13.2.4 User credentials and relevant information for accessing those services.
  • 13.3 If We, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, any sums paid by you in relation to that order will be refunded within 14 calendar days.
  • 13.4 Payment for the Services shall be taken via your chosen payment method, immediately for any setup fee that corresponds to the service plan you purchased and at the same day of each subsequent month (“billing cycle”) for charges accrued during the previous month (“billing cycle”) AND/OR as indicated in the order confirmation you received. Please note your bank/card issuer may charge you a fee (processing, currency conversion, foreign transaction, etc.) since the transaction is technically made in Mexico and in some cases might be settled in mexican currency, MXN pesos, even if our site is configured for US dollars, USD, this may depend on your local regulations and form of payment policies.
  • 13.5 We aim to fulfill your Order within 2-3 working days or if not, within a reasonable period following your Order, unless there are exceptional circumstances. If we cannot fulfill your Order within a reasonable period, we will inform you at the time you place the Order by a note on the relevant web page or by contacting you directly after you place your Order. Time is not of the essence of the Contract, which means we will aim to fulfill your Order within any agreed timescales but this is not an essential term of the Contract and we will not be liable to you if we do not do so. If the Services are to begin within 14 calendar days of Our acceptance of your order, at your express request, you will be required to expressly acknowledge that your statutory cancellation rights, detailed below in Clause 14, will be affected.
  • 13.6 Manufacturing Excellence Institute shall use all Our reasonable endeavours to provide the Services with reasonable skill and care, commensurate with best trade practice.
  • 13.7 In the event that Services are provided that are not in conformity with your order and thus incorrect, you should contact Us immediately to inform Us of the mistake. We will ensure that any necessary corrections are made within five (5) working days.
  • Additional terms and conditions may apply to the provision of certain Services. You will be asked to read and confirm your acceptance of any such terms and conditions when completing your Order.
  • 13.8 Manufacturing Excellence Institute provides technical support via our online support forum and/or by email. Manufacturing Excellence Institute makes every effort possible to respond in a timely manner but we do not guarantee a particular response time.

14. Cancellation of Orders and Services

We want you to be completely satisfied with the Products or Services you order from Manufacturing Excellence Institute. If you need to speak to us about your Order, then please contact customer care by email at contact@manufacturingx.com . You may cancel an Order that we have accepted or cancel the Contract. If any Specific Terms accompanying the Service contain terms about cancelling the Service, the cancellation policy in the Specific Terms will apply.
  • 14.1 If you are a consumer based within the European Union, you have a statutory right to a “cooling off” period. This period begins once your order is confirmed and the contract between Manufacturing Excellence Institute and you is formed and ends at the end of 14 calendar days after that date. If you change your mind about the Services within this period and wish to cancel your order, please inform Us immediately using the following email: sales@manufacturingx.com. Your right to cancel during the cooling off period is subject to the provisions of sub-Clause 14.2.
  • 14.2 As specified in sub-Clause 13.6, if the Services are to begin within the cooling off period you are required to make an express request to that effect. By requesting that the Services begin within the 14 calendar day cooling off period you acknowledge and agree to the following:
  • 14.2.1 If the Services are fully performed within the 14 calendar day cooling off period, you will lose your right to cancel after the Services are complete.
  • 14.2.2 If you cancel the Services after provision has begun but is not yet complete you will still be required to pay for the Services supplied up until the point at which you inform Us that you wish to cancel. The amount due shall be calculated in proportion to the full price of the Services and the actual Services already provided. Any sums that have already been paid for the Services shall be refunded subject to deductions calculated in accordance with the foregoing. Refunds, where applicable, will be issued within 5 working days and in any event no later than 14 calendar days after you inform Us that you wish to cancel.
  • 14.3 Cancellation of Services after the 14 calendar day cooling off period has elapsed shall be subject to the specific terms governing those Services and may be subject to a minimum contract duration.
  • 14.4 Please note that in any case products or services at a discounted prices and/or with special offers and/or discount codes, cannot be cancelled, or the cancelation fee will be equal to the amount paid for that service/product; also in general a service used 20% or more cannot be cancelled.

16. How We Use Your Personal Information (Data Protection)

  • 16.1 All personal information that We may collect (including, but not limited to, your name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and your rights under that Act.

  • 16.2.1 Provide Our Services to you;
  • 16.2.2 Process your payment for the Services; and
  • 16.2.3 Inform you of new products and services available from Us. You may request that We stop sending you this information at any time.
  • 16.3 In certain circumstances (if, for example, you wish to purchase Services on credit), and with your consent, We may pass your personal information on to credit reference agencies. These agencies are also bound by the Data Protection Act 1998 and should use and hold your personal information accordingly.

If We are required to make any changes to these Terms and Conditions by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

19. Availability of the Website

  • 19.1 The Website is provided “as is” and on an “as available” basis. Manufacturing Excellence Institute uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
  • 19.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

20. Limitation of Liability

  • 20.1 To the maximum extent permitted by law, We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. You should be aware that you use the Website and its Content at your own risk.
  • 20.2 In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal, however the laws of United Mexican States supersede all others regardless the customer/user jurisdiction.
  • 20.3 Since this site is focused on the international market, the language ​​used is English and you agree that you understand it.

21. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

22. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

23. Third Party Rights

Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and Manufacturing Excellence Institute.

  • 24.1 All notices / communications shall be given to Us by email to contact@manufacturingx.com. Such notice will be deemed received 3 days after the email is received in full on a business day.
  • 24.2 We may from time to time, if you opt to receive it, send you information about Our products and/or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from Us.

25. Law and Jurisdiction

These Terms and Conditions and the relationship between you and Manufacturing Excellence Institute shall be governed by and construed in accordance with the Laws of Jalisco and United Mexican States and  Manufacturing Excellence Institute and you agree to submit to the exclusive jurisdiction of United Mexican States.

  • 9.1.6 No debe hacerse pasar por otras personas, en particular por empleados y representantes de Manufacturing Excellence Institute Manufacturing Excellence Institute o de nuestras filiales; y
  • 9.1.7 No debe utilizar nuestro Sistema para comunicaciones masivas no autorizadas, como correo basura (spam).
9.2 Usted reconoce que Manufacturing Excellence Institute se reserva el derecho de supervisar todas las comunicaciones que nos envíe o que utilicen nuestro sistema.
9.3 Usted reconoce que Manufacturing Excellence Institute podrá conservar copias de todas las comunicaciones que nos envíe o que utilicen nuestro sistema.
9.4 Usted reconoce que cualquier información que nos envíe a través de nuestro sistema podrá ser modificada por nosotros de cualquier manera y, por la presente, renuncia a su derecho moral a ser identificado como el autor de dicha información. Cualquier restricción que desee imponer sobre nuestro uso de dicha información deberá comunicárnosla con antelación y nos reservamos el derecho a rechazar dichas condiciones e información asociada.

10. Cuentas

10.1 Para obtener Servicios en este Sitio Web y utilizar otras partes del Sistema, deberá crear una Cuenta que contendrá ciertos datos personales e Información de Pago. Estos datos pueden variar según su uso del Sitio Web, ya que es posible que no le solicitemos información de pago hasta que desee realizar una compra. Al continuar utilizando este Sitio Web, declara y garantiza que:
  • 10.1.1 Toda la información que envíe es exacta y veraz;
  • 10.1.2 Tiene autorización para enviar Información de Pago cuando sea necesaria; y
  • 10.1.3 Mantendrá esta información exacta y actualizada. La creación de una Cuenta constituye una confirmación adicional de su declaración y garantía.
  • 10.2 Se recomienda no compartir los datos de su Cuenta, en particular su nombre de usuario y contraseña. No nos responsabilizamos de ninguna pérdida o daño que se produzca como resultado de compartir los datos de su Cuenta. Si utiliza un ordenador compartido, se recomienda no guardar los datos de su Cuenta en su navegador de internet.
  • 10.3 Si tiene motivos para creer que otra persona ha obtenido los datos de su Cuenta sin su consentimiento, póngase en contacto con nosotros de inmediato para suspender su Cuenta y cancelar cualquier pedido o pago no autorizado que pueda estar pendiente. Tenga en cuenta que los pedidos o pagos solo pueden cancelarse hasta que se inicie la prestación de los Servicios. En caso de que se inicie una prestación no autorizada antes de que nos notifique la naturaleza no autorizada del pedido o pago, se le cobrará el período comprendido entre el inicio de la prestación de los servicios y la fecha de notificación, pudiendo aplicarse un cargo por un ciclo de facturación de un mes.
  • 10.4 Al elegir su nombre de usuario, deberá cumplir con los términos establecidos anteriormente en la Cláusula 9. Cualquier incumplimiento podría resultar en la suspensión y/o eliminación de su Cuenta.

11. Terminación y cancelación de cuentas

  • 11.1 Tanto Manufacturing Excellence Institute como usted podrán cancelar su Cuenta. Si cancelamos su Cuenta, se le notificará por correo electrónico y se le proporcionará una explicación del motivo. Sin perjuicio de lo anterior, nos reservamos el derecho de cancelarla sin justificación.
  • 11.2 Si cancelamos su Cuenta, se cancelarán todos los pedidos o pagos actuales o pendientes y no se podrá prestar los Servicios.

12. Servicios, precios y disponibilidad

12.1 Si bien se ha hecho todo lo posible para garantizar que todas las descripciones generales de los Servicios disponibles en Manufacturing Excellence Institute correspondan a los Servicios reales que se le proporcionarán, no nos responsabilizamos de ninguna variación en estas descripciones, ya que la naturaleza exacta de los Servicios puede variar según sus necesidades y circunstancias individuales. Esto no excluye nuestra responsabilidad por errores debidos a nuestra negligencia y se refiere únicamente a variaciones de los Servicios correctos, no a Servicios completamente diferentes. Consulte la subcláusula 13.8 para ver los Servicios incorrectos.
12.2 Cuando corresponda, se le podrá solicitar que seleccione el Plan de Servicios requerido.
12.3 No declaramos ni garantizamos que dichos Servicios estarán disponibles en todo momento y no podemos confirmar necesariamente su disponibilidad hasta que confirme su Pedido. Las indicaciones de disponibilidad no se proporcionan en el Sitio Web.
12.4 Toda la información de precios en el Sitio Web es correcta en el momento de su publicación y se expresa en dólares americanos (USD) a menos que se indique lo contrario; sin embargo, se le podría cobrar en moneda local equivalente cuando corresponda.. Nos reservamos el derecho a cambiar los precios y a modificar o eliminar cualquier oferta especial ocasionalmente y según sea necesario.
12.5 En el caso de que se modifiquen los precios durante el período entre la realización de un pedido de Servicios y el procesamiento por nuestra parte de dicho pedido y el pago, se utilizará el precio vigente en el momento del pedido.

13. Pedidos y prestación de servicios

13.1 Ninguna parte de este Sitio Web constituye una oferta contractual susceptible de aceptación. Su pedido constituye una oferta contractual que, a nuestra entera discreción, podemos aceptar. Nuestra aceptación se indica mediante el envío de un correo electrónico de confirmación del pedido. Solo después de enviarle dicho correo electrónico se formalizará un contrato vinculante entre Manufacturing Excellence Institute y usted.
13.2 Las confirmaciones de pedido, según la subcláusula 13.1, se le enviarán antes del inicio de los Servicios e incluirán la siguiente información:
13.2.1 Confirmación de los Servicios solicitados, incluyendo detalles de sus características principales.
13.2.2 Precios detallados de los Servicios solicitados. Para clientes en México que requieran factura, favor de solicitarla por email a sales@manufacturingx.com
13.2.3 Fechas y horarios relevantes para la prestación de los Servicios;
13.2.4 Credenciales de usuario e información relevante para acceder a dichos servicios.
13.3 Si, por cualquier motivo, no aceptamos su pedido, no se realizará ningún pago en circunstancias normales. En cualquier caso, cualquier importe pagado por usted en relación con dicho pedido se le reembolsará en un plazo de 14 días naturales.
13.4 El pago de los Servicios se realizará a través del método de pago que usted haya elegido, inmediatamente por cualquier cargo de instalación correspondiente al plan de servicio que haya adquirido y el mismo día de cada mes posterior ("ciclo de facturación") por los cargos acumulados durante el mes anterior ("ciclo de facturación") y/o según lo indicado en la confirmación del pedido que haya recibido.  Tenga en cuenta que su banco/emisor de tarjeta puede cobrarle una comisión (por procesamiento, conversión de moneda, transacción foránea, etc.) ya que la transacción se realiza técnicamente en México y en algunos casos puede liquidarse en moneda mexicana, MXN pesos, incluso si nuestro sitio está configurado para USD dólar estadounidense, esto puede depender de sus regulaciones locales y políticas de forma de pago.
13.5 Nuestro objetivo es completar su Pedido en un plazo de 2 a 3 días laborables o, en su defecto, en un plazo razonable tras su realización, salvo circunstancias excepcionales. Si no podemos completar su Pedido en un plazo razonable, se lo informaremos al realizarlo mediante una nota en la página web correspondiente o poniéndonos en contacto con usted directamente después de realizarlo. El tiempo no es esencial para el Contrato, lo que significa que intentaremos cumplir con su Pedido dentro de los plazos acordados. Sin embargo, este no es un término esencial del Contrato y no seremos responsables ante usted si no lo hacemos. Si los Servicios deben comenzar dentro de los 14 días naturales siguientes a nuestra aceptación de su pedido, a petición suya expresa, deberá reconocer expresamente que sus derechos legales de cancelación, detallados a continuación en la Cláusula 14, se verán afectados.
13.6 Manufacturing Excellence Institute hará todo lo razonablemente posible para prestar los Servicios con la debida diligencia y esmero, de acuerdo con las mejores prácticas comerciales.
13.7 En caso de que se presten Servicios que no se ajusten a su pedido y, por lo tanto, sean incorrectos, deberá ponerse en contacto con nosotros inmediatamente para informarnos del error. Nos aseguraremos de que se realicen las correcciones necesarias en un plazo de cinco (5) días hábiles.
Pueden aplicarse términos y condiciones adicionales a la prestación de ciertos Servicios. Se le solicitará que lea y confirme su aceptación de dichos términos y condiciones al completar su pedido.
13.8 Manufacturing Excellence Institute proporciona soporte técnico a través de nuestro foro de soporte en línea o email. Manufacturing Excellence Institute hace todo lo posible por responder de manera oportuna, pero no garantizamos un tiempo de respuesta específico.

14. Cancelación de pedidos y servicios

Queremos que esté completamente satisfecho con los Productos o Servicios que solicite a Manufacturing Excellence Institute. Si necesita hablar con nosotros sobre su Pedido, comuníquese con atención al cliente por correo electrónico a contact@manufacturingx.com. Puede cancelar un Pedido que hayamos aceptado o cancelar el Contrato. Si alguno de los Términos Específicos que acompañan al Servicio contiene términos sobre la cancelación del Servicio, se aplicará la política de cancelación de los Términos Específicos.
14.1 Si usted es un consumidor residente en la Unión Europea, tiene derecho legal a un período de "reflexión". Este período comienza una vez que se confirma su pedido y se forma el contrato entre Manufacturing Excellence Institute y usted, y finaliza al final de los 14 días naturales posteriores a esa fecha. Si cambia de opinión sobre los Servicios dentro de este período y desea cancelar su pedido, infórmenos de inmediato a través del siguiente correo electrónico: sales@manufacturingx.com. Su derecho a cancelar durante el período de reflexión está sujeto a las disposiciones de la subcláusula 14.2.
14.2 Según lo especificado en la subcláusula 13.6, si los Servicios deben comenzar dentro del período de reflexión, deberá presentar una solicitud expresa a tal efecto. Al solicitar que los Servicios comiencen dentro del período de reflexión de 14 días naturales, usted reconoce y acepta lo siguiente:
14.2.1 Si los Servicios se prestan en su totalidad dentro del plazo de 14 días naturales, perderá su derecho a cancelar una vez finalizados.
14.2.2 Si cancela los Servicios una vez iniciada su prestación, pero aún no se han completado, deberá abonar los Servicios prestados hasta el momento en que nos informe de su deseo de cancelar. El importe adeudado se calculará en proporción al precio total de los Servicios y a los Servicios ya prestados. Cualquier importe ya pagado por los Servicios se reembolsará sujeto a las deducciones calculadas de conformidad con lo anterior. Los reembolsos, cuando corresponda, se emitirán en un plazo de 5 días hábiles y, en cualquier caso, a más tardar 14 días naturales después de que nos informe de su deseo de cancelar.
14.3 La cancelación de los Servicios una vez transcurrido el período de reflexión de 14 días naturales estará sujeta a los términos específicos que rigen dichos Servicios y podrá estar sujeta a una duración mínima del contrato.
14.4 Tenga en cuenta que en ningún caso los productos o servicios a precios rebajados y/o con ofertas especiales y/o con códigos de descuento, podrán ser cancelados, o el costo de cancelación será igual al importe pagado por dicho servicio/producto; así mismo en general un servicio utilizado en un 20% o más no podrá ser cancelado.

16. Cómo utilizamos su información personal (Protección de datos)

16.1 Toda la información personal que recopilemos (incluidos, entre otros, su nombre y dirección) se recopilará, utilizará y conservará de conformidad con las disposiciones de la Ley de Protección de Datos de 1998 y sus derechos conforme a dicha ley.
16.2 Podemos utilizar su información personal para:
16.2.1 Prestarle nuestros Servicios;
16.2.2 Procesar su pago por los Servicios; y
16.2.3 Informarle sobre nuevos productos y servicios disponibles. Puede solicitar que dejemos de enviarle esta información en cualquier momento.
16.3 En determinadas circunstancias (por ejemplo, si desea adquirir Servicios a crédito), y con su consentimiento, podremos compartir su información personal con agencias de crédito. Estas agencias también están sujetas a la Ley de Protección de Datos de 1998 y deben usar y conservar su información personal en consecuencia.
16.4 No compartiremos su información personal con terceros sin su consentimiento expreso.

17. Descargos de responsabilidad

17.1 No garantizamos ni declaramos que el Sitio Web satisfaga sus necesidades, que sea de calidad satisfactoria, que sea adecuado para un propósito específico, que no infrinja los derechos de terceros, que sea compatible con todos los sistemas, que sea seguro ni que toda la información proporcionada sea precisa. No garantizamos ningún resultado específico del uso de nuestro Servicio o Servicios.
17.2 Ninguna parte de este Sitio Web pretende constituir asesoramiento y no debe confiarse en su Contenido para tomar decisiones ni realizar ninguna acción de ningún tipo.
17.3 Ninguna parte de este Sitio Web pretende constituir una oferta contractual susceptible de aceptación.
17.4 Si bien hacemos todos los esfuerzos razonables para garantizar que el Sitio Web sea seguro y esté libre de errores, virus y otro malware, le recomendamos encarecidamente que se responsabilice de su propia seguridad en Internet, de sus datos personales y de sus ordenadores.

18. Cambios en las Instalaciones y estos Términos y Condiciones

Nos reservamos el derecho de modificar el Sitio Web, su Contenido o estos Términos y Condiciones en cualquier momento. Usted quedará sujeto a cualquier modificación de los Términos y Condiciones desde la primera vez que utilice el Sitio Web después de la modificación. Si la ley nos obliga a modificar estos Términos y Condiciones, estos se aplicarán automáticamente a cualquier pedido pendiente, así como a cualquier pedido que realice en el futuro.

19. Disponibilidad del sitio web

19.1 El Sitio Web se proporciona "tal cual" y según disponibilidad. Manufacturing Excellence Institute utiliza las mejores prácticas de la industria para garantizar un alto tiempo de actividad, incluyendo una arquitectura con tolerancia a fallos alojada en servidores en la nube. No garantizamos que el Sitio Web o las Instalaciones estén libres de defectos o fallos, ni ofrecemos reembolsos por interrupciones. No ofrecemos garantías (expresas o implícitas) de idoneidad para un fin determinado, exactitud de la información, compatibilidad ni calidad satisfactoria.
19.2 No asumimos ninguna responsabilidad por interrupciones o falta de disponibilidad del Sitio Web derivadas de causas externas, incluyendo, entre otras, fallos del equipo del proveedor de servicios de internet (ISP), fallos del equipo host, fallos de la red de comunicaciones, fallos de suministro eléctrico, fenómenos naturales, actos de guerra o restricciones legales, y censura.

20. Limitación de responsabilidad

20.1 En la medida máxima permitida por la ley, no asumimos ninguna responsabilidad por pérdidas o daños directos o indirectos, previsibles o no, incluyendo cualquier daño indirecto, consecuente, especial o ejemplar que surja del uso del Sitio Web o de cualquier información contenida en él. 20.2 En caso de que alguno de estos términos se considere ilegal, inválido o inaplicable, dicho término se considerará separado de estos Términos y Condiciones y no afectará la validez ni la aplicabilidad de los Términos y Condiciones restantes. Este término se aplicará únicamente en las jurisdicciones donde un término en particular sea ilegal, sin embargo, las leyes de los Estados Unidos Mexicanos sustituyen a todas las demás independientemente de la jurisdicción del cliente/usuario.
20.3 Ya que este sitio está enfocado al mercado internacional, el lenguaje usado es el Inglés y  usted acepta que lo comprende.

21. Sin renuncia

En el caso de que alguna de las partes de estos Términos y Condiciones no ejerza cualquier derecho o recurso aquí contenido, esto no se interpretará como una renuncia a ese derecho o recurso.

22. Términos y condiciones anteriores

En caso de conflicto entre estos Términos y Condiciones y cualquier versión anterior de los mismos, prevalecerán las disposiciones de estos Términos y Condiciones a menos que se indique expresamente lo contrario.

23. Derechos de terceros

Nada de lo dispuesto en estos Términos y Condiciones conferirá derechos a terceros. El acuerdo establecido en estos Términos y Condiciones se celebra entre usted y Manufacturing Excellence Institute.

24. Comunicaciones

24.1 Todas las notificaciones/comunicaciones nos deberán ser enviadas por correo electrónico a contact@manufacturingx.com. Dicha notificación se considerará recibida 3 días después de su recepción completa en un día hábil.
24.2 Es posible que, ocasionalmente, si usted decide recibirla, le enviemos información sobre nuestros productos y/o servicios. Si no desea recibir dicha información, haga clic en el enlace "Cancelar suscripción" en cualquier correo electrónico que reciba de nosotros.

25. Ley y jurisdicción

Estos Términos y Condiciones y la relación entre usted y Manufacturing Excellence Institute se regirán e interpretarán de conformidad con las Leyes de Jalisco y los Estados Unidos Mexicanos y Manufacturing Excellence Institute y usted acepta someterse a la jurisdicción exclusiva de los Estados Unidos Mexicanos.
